Am I a tax resident of Belgium?

Belgium does not use a simple day count — residency turns on where your home and economic life actually are. Here is the test, and what it means once it applies.

The residency test in Belgium

Belgium does not test residency by a fixed day count. Instead the test looks at where your permanent home, family, and economic interests actually sit — a facts-and-circumstances test rather than a number to count against.

Residency test
Belgian residence follows domicile, or the seat of fortune if there is no domicile, with a rebuttable presumption from registration in the population register. No statutory day count is stated in the sources, so no day threshold is recorded. [source]PwC Worldwide Tax Summaries“Residents of Belgium are those who have established their domicile or, if they do not have a domicile in Belgium, their centre of economic interests in Belgium. Persons deemed to be residents of Belgium are those who have registered in the population register of a commune in Belgium.”View source · accessed 2026-10-26
Tax year period
1 January to 31 December (as of 2026)PwC Worldwide Tax Summaries“The Belgian tax year runs from 1 January to 31 December.”View source · accessed 2026-10-26 — The Belgian income year is the calendar year from 1 January to 31 December. The return for income year x is filed in year x+1, which Belgium calls the tax (assessment) year.
Worldwide taxation scope
Residents are taxed on worldwide income, and non-residents only on Belgian-source income. Foreign income covered by a tax treaty is usually exempt in Belgium but still counts when the rate is set (exemption with progression). Short stay tax trigger
Belgium has no minimum number of days that avoids Belgian filing and tax on work done in Belgium; relief comes only from the employment article of a tax treaty. The 90-day figure seen in Belgian practice is an immigration limit for work permits, not a tax threshold. [source]KPMG“Technically, there is no threshold/minimum number of days that exempts the employee from the requirements to file and pay tax in Belgium.”View source · accessed 2026-10-26

If your situation is borderline

With no day count to fall back on, Belgium weighs facts a calendar can’t: where your home actually is, where your family lives, and where your economic life is centred. Two people with identical travel patterns can land on opposite sides of this test depending on those ties — a day-counter would not help either of them.

What residency actually changes

Once you are tax resident, Belgium generally taxes your worldwide income, topping out at 53.5%Orbitax“over EUR 51,070 - 50%”View source · accessed 2026-10-26. Combined top marginal rate on earned income is the 50% federal band (above EUR 51,070 for income year 2026) plus a municipal surcharge on the tax due, 7% on average, giving 53.5% (50.0% to 54.5% for surcharges of 0% to 9%). Employee social security of 13.07% is not included, and KPMG puts the maximum surcharge at 10% where PwC says 9%. Stay a non-resident, and Belgium typically taxes only income sourced there.

When to talk to an advisor

This page maps Belgium’s general residency test. It cannot weigh your treaty position, your specific ties, or the timing of a move. If meaningful money depends on the answer, have a qualified advisor in Belgium (and in your home country) review your situation before you act.
